Proud Ponds Terms and Conditions of Use

1. Terms

By accessing this website (https://proudponds.com/), you agree to abide by these Terms and Conditions. If you do not accept any part of these terms, you are prohibited from using this site. The content on this website is protected by copyright and trademark laws.

By signing up for water feature services, you agree to abide by these Terms and Conditions.


Termination of Contract


The Contract ends on scheduled date unless one of the parties ends the contract before that time. If one of the parties chooses to end the Contract prior to service completion, no refunds will be issued. In the event of the sale of the client's home, the contract will be transferred to the new homeowner.


Invoices


Proud Ponds will invoice the Client based on Payment Option selected from your estimate. The Client agrees to pay this and future invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in suspension or termination of the service. If, at any time, for any reason the Client is unable to, or does not, pay for purchases when due, Client agrees to pay a service charge of 2% per month on the unpaid balance.

Credit cards add 4% of the total, and may be billed seperately.

Payment Due in Full Immediately

(You will not be added to the list to be scheduled until payment is received. Signing the contract is an agreement of terms. Credit cards add 4% of the total, and may be billed seperately.)

Payment Methods

Payment will be made to Proud Ponds via cash, check, an approved payment card, ACH or by any other payment method determined by Proud Ponds. Fees may apply depending on payment options chosen. Payments are due upon receipt unless otherwise specified.

Fish Care

Although we take extra care to keep your fish safe and free of harm during your pond’s servicing, we cannot guarantee their health. Proud Ponds does not, at any time, take responsibility for the health and will not be held liable or negligible for the health of your fish. Our trained staff will use all of their skilled knowledge to properly clean and service your pond.

Leaks

Proud Ponds does not, at any time, take responsibility for any structural, mechanical issues, or leaks that may arise after the pond is cleaned and refilled. If an issue requiring a service call is covered under warranty, service will be provided as specified by the manufacturer warranty policy. Any issues not covered under a manufacturer warranty will be charged as a service call with labor and material to be paid in full at time of service.


Exploratory Cleanout

If Proud Ponds did not do a cleanout on the feature the previous year to this contract, the invoice price is treated as an estimate based on pictures provided/our previous experience with the feature. If, when our crew arrives, they determine the service would not be able to be completed within our estimated time frame, our crew will inform the water feature owner of this and there may be an additional charge based on exactly how long it will take to complete the cleanout. This additional charge would be discussed at the start of the visit, before any work commences. The additional charge follows our current labor rate of $150 per man hour of work completed beyond our estimate. Refund exception: If the team arrives and determines there will be an additional charge for the cleanout, you have the right to refuse the work and get a refund. This only applies if the water feature owner states they would not want the work done for the additional charge before any work has been completed. The water feature owner would receive a refund of all paid fees, minus a $500 cancellation fee.


2. Limited Use License

We grant you a temporary, non-transferable license to download one copy of the materials on the Proud Ponds website for personal, non-commercial use only. Under this license, you may not:

  • Modify, copy, or distribute the materials

  • Use the materials for commercial purposes or public display

  • Reverse engineer any software on our website

  • Remove any copyright or proprietary notations

  • Transfer materials to another person or mirror them on another server

Proud Ponds reserves the right to terminate this license at any time if you violate these restrictions. Upon termination, you must delete any downloaded materials, whether in electronic or printed format.

3. Disclaimer

All materials on the Proud Ponds website are provided “as is.” We do not make warranties, express or implied, and we disclaim all other warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Additionally, we do not guarantee the accuracy, reliability, or completeness of the materials on our website or any linked sites.

4. Limitations

Proud Ponds and its suppliers shall not be liable for any damages resulting from the use or inability to use materials on this website, even if we or an authorized representative have been advised of the possibility of such damages. Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so these limitations may not apply to you.

5. Revisions & Updates
